Terms and Conditions
These Terms and Conditions (“Terms”) govern the use of Amplify Studio, operated by 730 Eddy Studios, located at 115 Clover St., Holland, MI. By booking, entering, or using the studio, you agree to be bound by these Terms.
1. Studio Use and Conduct
- All clients and guests must respect the studio space, equipment, and team.
- Smoking, illegal substances, and hazardous materials are strictly prohibited on premises.
- Food and drink are allowed in designated areas only.
- You are responsible for any damage caused by you or your team during your rental.
2. Scope, Budget, and Additional Costs
- All services will be performed as outlined in the agreed-upon Scope of Work or project brief.
- Budget estimates are based on this scope. Any work outside of scope will be billed separately.
- Additional costs, such as extended studio time, added equipment, overtime, or client-requested changes, will be charged at cost plus applicable time and materials.
- Clients will be notified in advance whenever possible before out-of-scope work begins.
3. Subscription Terms and Billing
- Monthly subscription packages (e.g., Amplify Pro, Amplify Plus) are billed at the agreed monthly rate.
- Subscriptions include defined hours of studio access, number of shoot days, and content deliverables, as listed in your package.
- Subscription terms are month-to-month unless otherwise specified.
- Unused hours or deliverables do not roll over unless arranged in writing.
- Additional studio time or content beyond the subscription will be billed according to the agreed hourly or project rate.
- Subscriptions can be canceled with 30 days’ written notice. No partial-month refunds will be issued once the billing cycle begins.
4. Booking and Cancellation
- Bookings require payment in full to confirm your time slot unless included in a subscription plan.
- Cancellations made more than 48 hours before the session will be refunded in full.
- Cancellations made within 48 hours of the session will be refunded at 50%.
- No-shows and same-day cancellations are non-refundable.
5. Rights Release
By using the studio and participating in production activities:
- You grant 730 Eddy Studios and Amplify Studio the non-exclusive right to use behind-the-scenes footage, photography, and content captured in the space for promotional purposes, unless otherwise agreed in writing.
- If our team participates in filming or content capture beyond space rental, a separate production agreement and media release will be provided for talent, appearances, or voice recordings.
6. Copyright Ownership and Protection
- All original content created by the client and their team during their rental remains the property of the client.
- If Amplify Studio or 730 Eddy provides creative, filming, editing, or post-production services, the following applies:
- All content is copyrighted to 730 Eddy Studios until full payment is received.
- Upon full payment, the client receives a non-transferable, royalty-free license to use the final deliverables as defined in the scope of work or invoice.
- Raw project files, edit files, or unused footage are not included unless explicitly agreed upon in writing.
8. Indemnity and Liability
- Clients shall indemnify and hold harmless Amplify Studio and 730 Eddy Studios from any claims, liabilities, damages, or legal costs arising from:
- Use of the studio space;
- Activities conducted on-site;
- Infringement of third-party rights in content created by the client.
9. Privacy and Security
- Any footage captured on-site is confidential and will not be shared externally by our team unless agreed upon in writing.
- The studio is monitored for security and operational purposes.
10. Miscellaneous
- These Terms are governed by the laws of the State of Michigan.
- Any disputes shall be resolved in the courts of Ottawa County, MI.
- We reserve the right to update or modify these Terms at any time.
